A Masimo alleges that, during a meeting to discuss a collaboration between the companies in 2013, Apple stole the technologies present in its smart watches launched some time later. The process was initiated with the justification that the Apple used Masimo's blood oxygen monitoring sensor technology in 2020, prompting the suspension of sales. The Watch 6 was Apple's first smart watch with this sensor, launched the same year the lawsuit was filed.

A Masimo mentions that the Cupertino company stole commercial secrets and presented another 10 patents during the meeting. A lawsuit filed in June 2021 by Masimo at the US International Trade Commission to prevent the import of new Apple Watch is also pending in the US courts.

In early 2023, a US judge ruled that yes, the Apple infringed Masimo's patent by importing and selling smartwatches with light-based pulse oximetry features and components.

The latest update on the case is that, in October, the United States International Trade Commission (USITC) agreed with the judge's decision made in January. This gave President Joe Biden 60 days to analyze the case and offer a veto to the USITC's decision and sales to continue normally. But the deadline ends on December 25, 2023 (yes, at Christmas). At the time of writing this article, the White House had not yet vetoed the US International Commission's decision, but both models should no longer be found on the website as of December 21st on the company's website. Sales in physical stores will be suspended from December 24th, on Christmas Eve.

Although the review period ends on December 25th, Apple is taking preventive measures to comply with the decision. This includes pausing sales of the Apple Watch Series 9 and Apple Watch Ultra 2 on Apple's website starting December 21st and in Apple stores after December 24th.
