During the hearing of the Consumer Protection Commission of the Chamber of Deputies, the vice president of Anatel, Marcelo Bechara de Souza Hobaika, commented on the agency's resolution that regulates consumer rights (Resolution 632/14-article 52) and stated that it he was misunderstood by the operators and that the companies made a mistake when informing the about the cut in service, sending only an SMS 30 days before the validation of the measure.

“I needed to do (update the business model), but not in the way it was done. It was done wrong and we're going to have to find a way for the consumer to be well informed and know what's going on. The Ministries of Communications and Justice and Anatel are involved with the companies. We believe that in a week, two, we will already have some measure of market consensus, involving agents and now, perhaps, bringing to the table the parliamentarians themselves, Procon. It is a debate that has to be done openly and frankly, as was done here.”

The parliamentarians of the Consumer Protection Commission of the Chamber of Deputies want revoke Anatel's resolution, if the problem is not resolved soon.

“I said and I repeat that this resolution is tailor-made, precisely to meet the needs of operators who have lost their voice service customers and are gaining more and more data customers and this will meet the operators' financial needs. What we propose is that, if operators do not review this position, we overturn this Anatel resolution in plenary.” explained deputy Marcos Rotta (PMDB-AM), one of the authors for the meeting.

The president of the Brazilian Association of Procons, Gisela Simona de Souza, highlighted that the service interruptions occupy the first place in the ranking of complaints in Brazil.

Recently, PROCON in Rio de Janeiro filed a public civil action against the four largest telephone operators to contest the cut in data service. The lawsuit asks consumers to continue using the internet access service under the that were contracted, under penalty of a daily fine of BRL 50. O PROCON wants that the change in mobile internet charges can only be applied to contracts signed after the lawsuit is filed.

The representatives of Oi, Tim, Claro and Vivo defended the right of the telephone companies stop data traffic of customers when the limit of the contracted internet franchise is reached. They stated that the measure is necessary because of the increase in demand and that s are communicated in advance about the blocking of services.
