Electronuclear, the state-owned company that is responsible for managing nuclear power plants in Brazil, did not inform the inspection bodies of the leakage of radioactive material that occurred at the nuclear power plant of cove 1. The company claims that asmall volume” of the harmful material ended up being “involuntarily released into the rainwater system”, even in the case of an “operational incident”. The note goes on to say that there is no need to comply with the “rite of notifications that would be mandatory in the event of an accident”, and that even after analyzing the episode, there was no “no significant result".
Despite this, the person responsible for supervising and controlling the nuclear program in Brazil, the Cnen, as well as the Federal Public Ministry and Ibama, pointed out that there was a delay in informing about the leak, which ended up generating doubts about the information that was provided by the company. For this reason, the competent bodies would like to carry out a deeper investigation into what happened, with the intention of ing the dimensions of this leak and also the possible damage caused to human health and the environment.
Recorded on September 16, 2022, the release of this radioactive material into the sea only came to the attention of the respective responsible agents almost two weeks later, on the 29th of the same month. An anonymous complaint was made with details and sent to the State Institute of the Environment — INEA –, which he ended up also sending to Cnen and IBAMA. The following day, September 30, IBAMA officials ed Eletronuclear officials, who initially denied the incident.
Days before, Eletronuclear had received a face-to-face visit from commission technicians, and Cnen questioned the reason for the delay in communicating the leak, mainly because of that visit. According to an operating license from IBAMA given to the plant indicates that “environmental accidents must be reported via the National System of Environmental Emergencies immediately after the incident".

At first, the state-owned company informed the authorities that the leaked radioactive material had been contained that had not really leaked from the facilities, however, this version ended up changing later, and Eletronuclear itted that a small part actually reached the sea. This past Tuesday, March 21, a public civil action was filed in Federal Justice in Angra dos Reis against the state-owned Eletronuclear, being accused of acting with irresponsibility and lack of transparency.
The following day, March 22, the judge in charge of the case determined that Eletronuclear must assess all possible damages that may have affected the Bay of Itaorna and that it make public the “objective information about the accident and the measures adopted to remedy the damage, in order to guarantee the right to information of the affected population and to prevent the manipulation of information".
A contestation of the case is foreseen by Eletronuclear in relation to the reports issued by Cnen and by IBAMA, in which they point out a delay in reporting the incident. The company understands that the spill had been dealt with internally, as an operational event according to the reports, and not an accident that would even involve immediate notification to the authorities — as expected by IBAMA.
