Last week the Union of Drivers and Workers of Taxi Companies of the State of São Paulo (Simtetaxi – SP) opened a lawsuit against Uber. However, the justice of São Paulo filed this Monday (4th). The injunction that asked for the suspension of the use of Uber in Brazil, as well as its withdrawal from the Google, Apple, Microsoft and Samsung application store was also knocked down. 5i6u2c
Magistrate Fernanda Gomes Camacho, of the 19th Civil Court, decided that the Uber can continue in activity and that a public action cannot determine the regularity of the application. According to the judge, the union needs to represent the case to the Prosecutor so that it can determine if the application is irregular or not.
Lawyer Ivana Có Crivelli, who defends the union, disagrees and says the judge “it is not letting taxi drivers defend themselves either individually or through a union entity”.
“A decision like this is highly frustrating in a democratic state of law (…) Taxi drivers form a category that is fighting for its livelihood. Their activity is professional and regulated”, completed.
Despite the extinction of the process, the union does not intend to give up and already planning a new strategy to take Uber off the air.
Through note, Uber said that “is a technology company that connects private partner drivers with s. We publicly reinforce our commitment to offering São Paulo a safe and reliable alternative for urban mobility”.
“Technological innovations have brought countless opportunities to people and cities. It is through technology that cities will become increasingly better and more accessible to citizens, who need to have their fundamental right to choose guaranteed”, says the statement.
