According to Procon, there was a unilateral change of contracts made by the operators, affecting s who had contracted internet with “unlimited data packages” with the reduction of speed after the end of the franchise.
The injunction was granted by the judge Fausto Jose Martins Seabra and, if the operators do not comply with the decision, they must bear the daily fine of BRL 25 thousand.
The limitations in the plans of “unlimited internet” started in November last year. the operator Living was the first operator to adopt the measure. Just after, TIM, of course e Oi started doing the same.
Last month ANATEL promised that it would solve this obstacle within two weeks, but so far, no news has been announced. THE Brazilian Association of Procons declared itself against the measure adopted by the operators and started a campaign across the country. Last week, a similar injunction was obtained in Rio de Janeiro.
A National Consumer Secretariat (Senacon), an organ linked to the Justice ministry, has already requested information from telephone operators in relation to the disagreements between the offer of unlimited service and contractual limitations, in order to the existence of misleading advertising and lack of information.
Herself - Host ANATEL says he sees no problem in cutting the franchise, as this change in the way of billing is a way of offsetting the drop in revenue from voice services.
If operators are obliged to maintain the service, even with limited speed, it is possible that costs are ed on to consumers.
